JAKARTA – Penganjuan Kasasi dan peninjauan kembali (PK) di Mahkamah Agung (MA) dapat dilakukan sepenuhnya secara elektronik terhitung mulai akta permohonan kasasi dan peninjauan kembali tertanggal 1 Mei 2024.
Pengiriman berkas permohonan kasasi dan peninjauan kembali sebagaimana dimaksud dilakukan melalui aplikasi Sistem Informasi Perkara Pengadilan (SIPP) versi 5.5.0, yang telah diluncurkan secara resmi oleh Ketua MA M. Syarifuddin di Jakarta, Jumat 26 April
“Kita semua bersyukur akhirnya berkat rida Allah dan ikhtiar maksimal dari kita semua, permohonan kasasi dan peninjauan kembali ke Mahkamah Agung dapat dilakukan sepenuhnya elektronik, terhitung mulai akta pengajuan kasasi/peninjauan kembali tertanggal 1 Mei 2024,” kata Syarifuddin sebagaimana dikutip dari laman resmi Kepaniteraan MA di Jakarta, Minggu.
Pemberlakuan pengajuan upaya hukum kasasi dan peninjauan kembali secara elektronik diyakini Syarifuddin akan membawa perubahan signifikan dalam sistem pemeriksaan perkara di MA. Dengan diberlakukannya kebijakan ini, tidak ada lagi berkas dokumen cetak yang dikirimkan ke MA.
“Pemeriksaan perkara kasasi dan peninjauan kembali sepenuhnya menggunakan berkas perkara (Bundel A dan Bundel B, red.) berbentuk dokumen elektronik,” terang dia.
Menurutnya, sistem elektronik ini mempermudah proses pemeriksaan perkara karena akses terhadap berkas bisa dilakukan tanpa terhalang waktu dan tempat. Kendati begitu, Ketua MA mengingatkan bahwa dokumen elektronik bersifat rentan untuk diubah atau dimodifikasi.
“Saya mengingatkan pentingnya peran quality control panitera pengadilan tingkat pertama. Proses QC (quality control) menjadi sangat perlu dalam implementasi pengajuan kasasi dan peninjauan kembali secara elektronik,” pesan dia.
Sementara itu, Panitera MA Heru Pramono mengatakan sistem pengajuan upaya hukum kasasi dan peninjauan kembali secara elektronik merupakan program prioritas MA. Untuk mengimplementasikan peradilan elektronik tersebut, MA telah menerbitkan tiga kebijakan.
Tiga kebijakan dimaksud, antara lain, Peraturan Mahkamah Agung (Perma) Nomor 6 Tahun 2022; Surat Keputusan Ketua Mahkamah Agung (SK KMA) Nomor 207/KMA/SK.HK2/X/2023; dan Surat Panitera Mahkamah Agung Nomor 712 /PAN/HK1.2.3/4/2024 tanggal 23 April 20
Pengajuan kasasi dan PK secara elektronik merupakan bagian dari sub-sistem implementasi pengadilan online yang merupakan salah satu program prioritas modernisasi manajemen perkara yang diamanatkan oleh Cetak Biru Pembaruan Peradilan 2010–2035,” kata Heru.
Dia menjelaskan, Panitera MA sedang mempersiapkan petunjuk pelaksanaan (juklak) untuk mengimplementasikan pengajuan upaya hukum kasasi dan peninjauan kembali secara elektronik tersebut.
“Saat ini kita juga sedang mempersiapkan juklak atau petunjuk pelaksanaan pengajuan upaya hukum kasasi/PK secara elektronik. Apabila juklak tersebut telah selesai kami susun, akan segera kami publikasikan,” tandasnya.
